These Terms and Conditions ("Terms") govern your access to and use of our website located at https://www.patchaero.com (the "Site"), including any content, features, services, information, or resources provided through the Site (collectively, the "Services").
 

By accessing, browsing, or using the Site or Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site or Services.

 

1. Eligibility You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site. By using the Site, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

• You may use the Site for lawful purposes only and in accordance with these Terms.
   

• You agree not to use the Site:

  • In any way that violates any applicable federal, state, local, or international law or regulation (including FAA regulations under Parts 61 or 141, TSA requirements for flight training, or Florida Statutes Chapters 330-332 governing aviation operations).

  • To transmit any unlawful, harmful, or objectionable content.

  • To interfere with or disrupt the Site or servers.

  • To attempt unauthorized access to any part of the Site.

3. Intellectual Property The Site and its contents (including text, graphics, logos, images, course descriptions, videos, and software) are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and view the Site for personal, non-commercial use only. No other rights are granted without our prior written consent.

 

4. Flight Training and Services Information The Site provides information about our flight training programs, courses (including aerobatic training), aircraft rental, instructor services, pricing estimates, schedules, and related aviation services.
 

• All descriptions, pricing, and availability are subject to change without notice.
   

• Enrollment in any flight training program or service requires a separate written agreement, payment, and compliance with all applicable FAA (e.g., Parts 61 or 141), TSA (for non-U.S. citizens), and Florida-specific aviation regulations (e.g., aircraft registration under Florida Statutes § 330.355 and operational standards).
   

• We do not guarantee acceptance into any program, completion timelines, certification/licensure, or employment outcomes. Flight training success depends on individual performance, weather, aircraft availability, regulatory changes, and other factors beyond our control.
   

• We reserve the right to refuse service or enrollment to any individual for any reason, including safety or regulatory concerns.

 

5. User Accounts (if applicable) If the Site allows account creation (e.g., for scheduling, payments, or student portals):

• You are responsible for maintaining the confidentiality of your account credentials.
   

• Notify us immediately of any unauthorized use.
   

• You agree to provide accurate, current information and update it as needed.

 

6. Payments and Fees Any payments made through the Site (e.g., deposits, lesson fees) are processed via third-party providers. All fees are non-refundable unless stated otherwise in a separate agreement. Additional terms may apply to flight training bookings, cancellations, or no-shows (e.g., 24-48 hour cancellation policy with forfeiture of fees).

 

7. Disclaimers and Limitation of Liability

• The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of accuracy, reliability, fitness for a particular purpose, or non-infringement.
   

• Aviation, including aerobatic maneuvers, involves inherent risks and aircraft are considered "dangerous instrumentalities" under Florida law, potentially imposing vicarious liability on owners/lessors for negligent operations (subject to federal limitations). We disclaim all liability for any injury, death, property damage, or other losses arising from flight training, aircraft operation, or use of our Services, except where prohibited by law.
   

• Assumption of Risk: By using the Services or enrolling in training, you acknowledge and voluntarily assume all risks associated with aviation activities, including but not limited to aerobatic flight, which is an inherently dangerous activity involving potential for sudden changes in altitude, G-forces, mechanical failures, weather hazards, pilot error, and other uncontrollable factors that may result in serious injury, death, or damage. You agree that we are not liable for harms arising from these inherent risks, as permitted under Florida law (e.g., similar to limitations in Florida Statutes § 331.501 for high-risk activities) or Federal law.
   

• In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility.
   

8. Indemnification You agree to indemnify, defend, and hold harmless us, our officers, instructors, affiliates, and agents from and against any and all claims, demands, actions, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from or related to: (i) your use of the Site or Services; (ii) your violation of these Terms; (iii) your infringement of any third-party rights; or (iv) your participation in any flight training or aviation activities, including aerobatic maneuvers, which you acknowledge as an inherently dangerous activity. This indemnification expressly includes, to the fullest extent permitted by Florida law, any claims for personal injury, death, property damage, or other losses arising from the inherent risks of aviation (e.g., mechanical failure, weather, G-forces, or pilot error), even if caused in whole or in part by our negligence (but excluding our gross negligence or intentional misconduct). You agree that this provision is clear and unequivocal and shall survive termination of these Terms.

 

9. Third-Party Links and Services The Site may contain links to third-party websites (e.g., FAA, TSA, payment processors). We are not responsible for their content, privacy practices, or availability.

 

10. Termination We may terminate or suspend your access to the Site at any time, without notice, for any reason, including violation of these Terms.

 

11. Governing Law and Dispute Resolution These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Florida. You agree to submit to the personal jurisdiction of such courts.

 

12. Changes to Terms We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after changes constitutes acceptance.
